Since 2007, 100 abortions out of almost 2 million are performed third trimaster. Do you know why? Because of severe mental retardation or because the woman's life is at risk.
I think the language of the constitution (which, of course, doesn't mention abortion), could be fairly read to make it an issue for the states. I also think that a reading of the due process clauses of the 5th and 14th amendments could be read to extend some federal protection for abortion rights (which is what I'd prefer).
Morally, I view abortion as an absolute right. From a legal standpoint, however, I think a court could decide in good faith that it's not constitutionally protected.
Things like letting the states decide just bothers me sometimes. I recently saw a study that said about 20 states would outlaw abortion in the first year Roe V. Wade was repealed.
